ZintGo — Terms & Conditions

1. What ZintGo is

ZintGo is a customer loyalty platform that connects you with participating businesses (Stores). Each Store sets its own earn rates, rewards, exclusions and validity rules within ZintGo. ZintGo facilitates points accrual and redemption but is not a party to your purchase from a Store.

2. Eligibility & accounts

  • You must be at least 16 years old (or older if required by your local law) and able to form a contract. If under 18, you confirm you have a parent/guardian’s consent.
  • One account per person. Provide accurate details (e.g., name, email/phone) and keep them current.
  • You are responsible for keeping your login secure and for all activity on your account.
  • We may suspend or close accounts that are fake, duplicated, or abusive, or that breach these Terms.

3. Earning points

  • Points are issued at the Store’s discretion (e.g., per visit, per item, or per bill). Any minimum spend, excluded items, or caps are set by the Store and shown in-app where applicable.
  • Dynamic QR codes generated by ZintGo are single-use and time-bound. Screenshots, re-scans, or tampered codes are invalid.
  • If your purchase is refunded/voided, the related points may be reversed.
  • Points may appear pending until a Store confirms the transaction.
  • Points have no cash value and are not transferable between accounts or to other programs.

4. Redeeming points & rewards

  • Redemptions are subject to Store availability, local promotions, and any minimum quantities/spend the Store sets. Some items/services may be excluded.
  • The Store may verify your identity before honouring a redemption.
  • If a transaction involving a redemption is later refunded, the redemption will not be re-issued unless the Store expressly allows it.

5. Expiry, tiers & changes

  • Points and rewards may expire. Expiry windows are configured by the Store (e.g., 6–12 months) and are shown in-app where available.
  • Stores may enable tiers with thresholds, benefits, and validity periods. Tiers and benefits may change with notice in-app.
  • Stores may join or leave ZintGo and may change their earn rates, rewards, or rules at any time.

6. Prohibited conduct & fraud

You must not:

  • Tamper with QR codes, use bots/automation, spoof location, or otherwise attempt to game ZintGo.
  • Misrepresent purchases or engage in abusive, harassing, or unlawful behaviour.

We may take action including reversal of points, suspension, or termination of your account.

7. Fees & charges

We do not charge consumers to use ZintGo. Your mobile data and device charges are your responsibility.

8. App permissions & privacy

  • Camera is used to scan loyalty QR codes.
  • Location (optional) helps show nearby Stores and deter fraud; you can disable it in your device settings.
  • Notifications (optional) let us send transactional updates (e.g., points earned).

We handle personal information in line with our Privacy Policy.

9. Intellectual property

ZintGo, including its software, branding, and content, is protected by IP laws. You receive a limited, revocable, non-transferable licence to use ZintGo for personal, non-commercial purposes in accordance with these Terms. You must not reverse engineer, copy, or exploit ZintGo except as allowed by law.

10. Third-party stores & services

  • Products and services are provided by independent Stores. We do not manufacture, sell, or warrant Store products/services. Your statutory rights (including under the Australian Consumer Law) are with the Store.
  • ZintGo may link to third-party services (e.g., mapping). We are not responsible for their content, availability, or terms.

11. Consumer guarantees & liability (Australia)

Nothing in these Terms excludes, restricts, or modifies any non-excludable rights under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law).

Subject to those rights and to the maximum extent permitted by law:

  • ZintGo is provided “as is” and we make no warranties about uninterrupted or error-free operation.
  • We are not liable for any indirect, incidental, special, or consequential loss, loss of data, profits, or opportunities.
  • Our total aggregate liability to you is limited to re-supplying the services or paying the cost of having them re-supplied.

12. Suspension & termination

We may suspend or terminate access to ZintGo if you breach these Terms, we suspect fraud, or to comply with law. You may close your account at any time via in-app settings or by contacting us. On closure, unredeemed points/rewards may be forfeited.

13. Changes to ZintGo or these Terms

We may update ZintGo and these Terms from time to time. Material changes will be notified in-app or by email. Your continued use after the effective date constitutes acceptance of the updated Terms.

14. Complaints & dispute resolution

If you have a complaint about:

  • a Store purchase: contact the Store first (your ACL rights lie with the Store); or
  • the ZintGo app/service: email support@niyatechlabs.au. We aim to respond within a reasonable time. Nothing limits your right to seek assistance from a regulator or court.

15. Governing law

These Terms are governed by the laws of Victoria, Australia, and subject to the non-exclusive jurisdiction of its courts and courts of appeal.

16. Definitions

  • Account: your ZintGo user profile.
  • Points: loyalty units issued by Stores via ZintGo that have no cash value.
  • Rewards: benefits a Store makes available for redemption with Points.
  • Stores: participating businesses that configure earn/redemption rules in ZintGo.
  • You: the natural person using ZintGo.
